LVL UP OÜ (hereinafter referred to as “Level up”) protects the personal data of the data subject, which led to drawing up of this Privacy Policy, concerning the processing of personal data of the data subject in connection with the provision of the Level up’s recruitment service to the client.

Level up as a controller of personal data is governed by the applicable national and EU law, including Regulation (EU) No 2016/679 of the European Parliament and of the Council (General Data Protection Regulation).

KEY DEFINITIONS

A data subject is a natural person about whom Level Up has information that can identify a natural person – that is, a potential candidate who, through the Level up platform, applies for a position offered by a client.

Personal data is any information about an identified or identifiable natural person.

Processing of personal data shall mean any operation with a data subject’s personal data, including collection, use, disclosure, storage, transmission, erasure, etc.

A client contract is a contract between Level up and a client seeking recruitment service.

WHAT KIND OF PERSONAL DATA IS PROCESSED BY LEVEL UP?

Identifying information – first name and surname;

Contact details – e-mail, telephone number;

Data based on the nature of the job offer and the client’s request – this information may include the data subject’s educational background, work experience, language skills, salary request, evidence of formal qualifications, current employer or other relevant information that the client needs to know about the data subject based on the nature of work.

Digital Data – Non-personalized technical data is collected from the data subject who visited the landing page in order to inform the data subject about the job advertisements offered later by the client via social media (Facebook Pixel).

FOR WHAT KIND OF PURPOSES AND HOW DOES LEVEL UP PROCESS PERSONAL DATA?

Level up processes and collects data to fulfil the contract between the client and Level up, which aims to find a suitable candidate based on job criteria. When applying for a position disclosed by Level up, the data subject consents to the processing of their data in accordance with this Privacy Policy and applicable law.

Level up collects the personal data of the data subject for clearly defined and legitimate purposes. Level up collects personal information in order to fulfil the wish of the client, based on the contract between the client and Level up, to find a suitable candidate according to the vacancy of the client.

Level up collects and processes only data that the data subject shares about himself/herself.

TO WHOM THE PERSONAL DATA IS TRANSFERRED?

Level up discloses personal data only to the extent and in the form necessary for the purposes listed in the privacy terms, including for the preparation and performance of contracts with the data subject or the transmission of future job offers to the data subject. Level up shall transmit the data subject’s data only to the client who ordered the recruitment service.

WHAT ARE THE RIGHTS OF A DATA SUBJECT?

Right to access personal data concerning them

The data subject shall have the right of access to the data concerning him/her and to obtain confirmation whether and what data concerning him/her is being processed. The data subject has the right to obtain information about how long the Level up data will be stored, to whom and to what extent they are transmitted. Also the information on how the data subject’s personal data will be processed must be ensured. Access to the data is possible by presenting it in a format which can be reproduced in writing, such requests will be answered by Level up within 30 days.

Right to rectify personal data

The data subject has the right to demand rectification of inaccurate data or if the client’s personal information has changed in the course of the process it can always be changed by approaching Level up.

Right to be forgotten

Level up is obliged to erase the data of the data subject if there is one or more of the circumstances set out in Article 17 of the Regulation, including where personal data is not no longer needed for the purpose for which they were collected or otherwise processed. However, if the client wishes to erase the data, but there is a legal basis for data processing, Level Up is not obliged to do so.

Right to raise objections

A data subject shall have the right to raise objections at any time to the processing operation of the personal data concerning him/her.

Right to withdraw consent

Where processing of personal data is based on consent, the data subject shall have the right to withdraw his/her consent at any time. Withdrawal shall have no retroactive effect and shall not affect retroactively the legality of processing of personal data at the time of the valid consent.

Right to file a complaint to the data protection supervisory authority

The data subject shall have the right at any time to contact the national data protection supervisory authority (Data Protection Inspectorate), if the data subject considers that the processing of personal data concerning him/her is incompatible with national and European Union law.

RETENTION AND SECURITY OF PERSONAL DATA

Data collected from non-personalized technical websites is stored indefinitely. 

Level up shall take appropriate technical and organizational measures to ensure an adequate level of security for personal data. All personal data shall be used solely for the purpose for which they were collected and shall only be processed by the controller.

CHANGE OF PRIVACY POLICY
